Limited Warranty and Exclusive Remedies

Limited Warranty.  MyNotifi warrants that for the period from the initial purchase date until the expiration of 24 months from initial purchase date that the MyNotifi device will function substantially in accordance with the documentation provided with them, but ONLY if product has at all times been used and maintained as directed by the applicable MyNotifi documentation, and NOT been subjected to abuse or other abnormal wear and tear. MyNotifi meets FDA class I (exempt) device standards and can only be used by one person. MyNotifi devices cannot be refurbished and then employed for additional use. As such, opened packages that are returned must be quarantined, documented, destroyed and disposed of properly. A $65 fee is applied for this service. The total amount of the refund is the total cost of purchase minus shipping cost incurred and $65 fee. Other returns must meet the requirements listed below in Exclusive remedies or which fail to function properly. In the event of the latter potential situation, the user must notify Customer Care at 800-541-1420 to obtain a resolution to the issue.

Exclusive Remedies.

Unopened Return Policy.  The customer wishing to return the device must notify support at number listed above to get authorization through a RMA form. The MyNotifi wristband device may be returned for any reason within 30 days of Ship Date as long as the product is UNOPENED and with original sales receipt. The purchaser assumes responsibility for shipping costs in this event. There is a $25 restocking fee applied. The total amount of the refund in this instance is cost of original purchase minus $25 stocking fee and minus the shipping cost incurred. Open Return Policy. The customer wishing to return the device must notify support at number listed above to get authorization through a RMA form. Opened MyNotifi devices may only be returned within 15 business days of actual Ship Date. The shipping of the return must be postmarked within the 15 business days of actual ship date. No refunds will be made for opened devices that do not meet the criteria listed above.

Disclaimers and Limitations of Liability.

MyNotifi  disclaims any and all other warranties for MyNotifi devices,  including but not limited to any warranty of merchantability or fitness for a particular purpose, and except for the foregoing express limited warranty, replacement policy and exclusive remedies stated above, MyNotifi is sold and distributed “AS IS” and with no warranties of any kind, express or implied.

No oral or written advice provided by MyNotifi or any authorized representative shall create a warranty. As some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, some or all of the above exclusions and limitations may not apply to you.

IN NO EVENT WILL MyNotifi BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, ACCESS, USE OR MALFUNCTION OF THE MyNotifi device, INCLUDING BUT NOT LIMITED, AND TO THE EXTENT PERMITTED BY LAW, TO DAMAGES FOR PERSONAL INJURIES, PROPERTY DAMAGE, LOST PROFIT, OR PUNITIVE DAMAGES FROM ANY CAUSES OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE RPM² INSERT, WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE AND WHETHER OR NOT MyNotifi HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL MyNotifi’s LIABILITY FOR ALL DAMAGES (EXCEPT AS REQUIRED BY APPLICABLE LAW) EXCEED THE ACTUAL PRICE PAID BY YOU FOR THE INSERTS.

SINCE SOME STATES/COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATIONS AND/OR EXCLUSION OR LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. THIS WARRANTY SHALL NOT BE APPLICABLE SOLELY TO THE EXTENT THAT ANY SPECIFIC PROVISION OF THIS WARRANTY IS PROHIBITED BY ANY FEDERAL, STATE, OR MUNICIPAL LAW, WHICH CANNOT BE PRE-EMPTED. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY BY JURISDICTION.
